This Privacy Policy (the “Privacy Policy”) describes online privacy practices for Hendrickson Holdings, L.L.C., its divisions and affiliates (collectively referred to herein as “Hendrickson”, “us”, “our”, or “we”). This Privacy Policy (together with our Terms of Use, https://www.hendrickson-intl.com/Terms-Of-Use), describes how we receive, use, transfer, disclose, communicate and otherwise process personal information we collect from or about you, or that you provide to us, through our Website. Please read this Privacy Policy carefully to understand how we will treat your personal information.

What Do We Mean By “Personal Information” and “Personal Data”?

We will retain your personal information for as long as needed to fulfill the purposes for which it was collected and to comply with our legal obligations, resolve disputes, and enforce our agreements. We do not sell your personal information for monetary compensation, but we do partner with third-party advertising and analytics partners, which may be considered a “sale” of personal information under applicable laws. We collect information which is considered sensitive personal information in some jurisdictions, such as a driver’s license or other state or government ID, to evaluate your job application, and we delete the personal information we collect in accordance with our data retention practices. Personal Information We May Collect, Use, and Share
Depending on how you interact with us, we may collect, use and share the following types of personal information:
1. Identifiers and Contact information. If you complete forms on our websites (e.g., Contact Form or Gauge Request), we may collect your name, company, city, state, country, and/or email address. If you complete such forms, we may also collect your street address or phone number, and collect other ID numbers like usernames.
2. Commercial and Payment information. If you purchase products or extended warranties on products , we might collect information about your buying preferences, and the vehicle(s) or related equipment you own or operate, such as the vehicle makes and models, serial numbers, suspension information, in-service dates and the names, addresses, and phone numbers of the purchasing person or the company and its contact. Alternatively, we might engage third-party payment processors, including CyberSource , to collect your credit card information on our behalf. Credit card information may be condidered as sensitive personal information under applicable data laws. Collection of such information is necessary for enabling you to complete payments and make purchases on our Website. If you refuse to provide such information to us, you may not be able to use our purchase related services, but this will not prevent you from using other features or services of the Website.
3. Internet or other electronic network activity information. If you browse or use the Website, we may collect information about the website browser you are using and other technical information, such as your IP address, device type, unique device identifiers (including device type – iOS or Android – and the device installation ID ) and advertising IDs. We may collect this information using cookies, web beacons, pixels and other similar online tracking technologies. How do we obtain your consent? (Applicable to residents of India)
As per the requirement of the Indian Digital Personal Data Protection Act, 2023 we shall obtain consent before we process any personal data about you. We intend to take consent in a manner that is free, informed, unconditional and unambiguous. The consent notice provided to you shall be presented in a specific manner with a clear affirmative action. Consent shall signify an agreement to the processing of your personal data for such specified purpose as may be informed to you in the notice.
In the notice for consent that we present to you where you are given the choice to consent on the processing, we shall also mention following things-

How We May Collect Personal Information
We collect personal information directly from you. For example, we may collect identifiers, contact, commercial, and payment information when you make an online purchase or sign up to receive our marketing communications. We may collect identifiers and contact information in conjunction with offer purchase incentives.
We may combine information we obtain from third parties and other sources. For example, if you have purchased one of our products and then purchase an extended warranty, we may combine information about you that we learn from third parties, like vehicle manufacturers, with information we already have. For example, we may combine the suspension model information with the vehicle’s manufacturer, model, and vehicle identification number.

We may also collect information from or about you passively. Job Applicant Information

Verification. We cannot respond to your request or provide you with personal information unless we can verify your identity and your authority to make the request and confirm that the personal information relates to you. A verifiable consumer privacy request must:
    • Provide sufficient information that allows us to reasonably verify you are the person about whom we have collected personal information or an authorized representative;
    • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
Authorized Agent. If you are a resident of California, Colorado, or Connecticut, you may, under certain circumstances, authorize another individual or a business, called an Authorized Agent, to make requests on your behalf. If you wish to have an Authorized Agent make a verifiable consumer request on your behalf, they will need to provide us with sufficient written proof that you have designated them as your Authorized Agent, and we will still require you to provide sufficient information to allow us to reasonably verify that you are the person about whom we collected personal information.
Hendrickson’s Response. We endeavor to respond to a verifiable consumer request within 45 days of receipt. If we require more time, we will notify you in writing of the reason and extension period. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding receipt of the verifiable consumer request. If we cannot comply with part or all of your request, we will explain the reasons in our response.
We do not charge a fee to process or respond to your verifiable consumer privacy request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Appeals. Residents of California, Colorado, Connecticut, Montana, Oregon, Texas, and Virginia have the right to appeal a denial of their request by contacting us as described in our notice of denial.
California “Shine the Light” Law
California Civil Code Section 1798.83 permits visitors to the Website who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not provide your personal information to third parties for their direct marketing purposes.
Nevada Disclosure
Residents of Nevada have the right to opt out of the sale of certain personal information to third parties. We currently do not sell your personal information as defined by Nevada law.
Your Canadian Privacy Rights
If you are located in Canada, you may contact privacy@hendrickson-intl.com to request access to your personal information that is in our possession, or request that we correct or update such information, subject to such limitations and restrictions as are permitted or required by applicable law. If you have created an account, you may also update or correct your personal information on your account profile.
You may also withdraw your consent to our continued collection, use or disclosure of your personal information, subject to reasonable notice, contractual restrictions and such other limitations and restrictions as are permitted or required by applicable law.

Your Indian Privacy Rights
If you are located in India, the following privacy/data protection rare accorded to you under India‘s DPDPA. You may contact our Grievance officer as mentioned under 'How to contact us' clause below in order to send a request to us in order to exercise rights under the Indian data privacy law.
Right Explanation
Right to access information about personal data You can request us for all information concerning your personal data. We are obligated to provide you with what personal data we have about you, the purposes for which we are processing such data and whether we share such data with third parties.
Right to correction and erasure You should exercise this request in case you want us to erase all personal data about you that is present in our records. Our compliance with erasure request is subject to any law that may require us to retain your personal data.
Right to nominate You have a right to nominate any other person as per rules whom you may want to transfer rights as available to you under the Indian laws. The nominated person can exercise these rights only in instance of your death or incapacitation.
Right to grievance redressal You have a right to grievance redressal in case you feel we are falling short of any obligation entrusted on us as required under any law. You can send this request to our grievance officer.


Your People’s Republic of China (“PRC”) Privacy Rights
If your are located in the PRC, you may exercise following rights regarding your personal information:
1. The right to access and copy personal information: You are entitled to access or obtain a copy of your personal information from us.
2. The right to reject or limit the use of personal information: You are entitled to restrict or raise objections to processing of your personal information.
3. The right to data portability: To the extend permitted by relevant regulators, you may request us to transfer your personal information to a designated data controller.
4. The right to correct: You are entitled to correct, update or supplement your personal information if inaccurate or incomplete.
5. The right to delete: You have the right to request deletion of your personal information where: (a) you believe our purpose of processing has been achieved, it is impossible to achieve such purpose, or your personal information is no longer necessary to achieve such purpose; (b) the we cease to provide products or services, or the storage period has expired; (c) you withdraw your consent; (d) you believe that we process your personal information in violation of laws, administrative regulations or agreement with you; (e) other circumstances stipulated by applicable laws and administrative regulations.
6. The right to obtain explanation: You have the right to request us to explain the rules for processing your personal information.
7. The right to withdraw consent: Where our processing of your personal information is based on your consent, you are entitled to withdraw your consent. Please note that the withdrawal of your consent will not affect our previous processing activities based on your consent.
8. The right to reject automatic decision-making: You are entitled to reject the decision we made about you solely based on automatic decision-making.

Additional European Union (“EU”) information and your Privacy Rights
Where provided under applicable law, we provide you with additional information on the processing of your personal data, and inform you about your EU and other privacy rights, as applicable in accordance with the local personal data protection laws.
EU lawful basis for processing your personal data.
We process on the following legal bases:
1. Contract: It is necessary for our performance of the contract you have agreed to enter with us. If you do not provide your personal data to us, we will not be able to carry out our obligations under the terms of the contract.
2. Legitimate Interests: We are permitted to process your personal data if it is based on our legitimate interests. In relation to general inquiry and complaints you send us, our legitimate interest is to provide you with information you have requested and to provide customer support. You can object to the processing that we carry out on the grounds of legitimate interests. See the section "EU rights of data subjects" below to find out how.
3. Consent: Where you have given us consent to do so, we provide you, or permit third parties to provide you, with information about goods or services which we feel may interest you. You have the right to withdraw your consent. Please see the section "EU rights of data subjects" below to find out how.
4. Legal Claims: We need to process your personal data to defend or establish a legal claim (for example, claims relating to the sale of our goods and services under contract law).
EU rights of data subjects, under the EU and other jurisdictions
You have the following rights, where provided under applicable law, regarding your personal data (each of which are subject to various exceptions and limitations):
1. The right to be informed: You have the right to be provided with clear, transparent and easily understandable information about how we use your information and your rights. This is why we are providing you with the information in this Privacy Policy.
2. The right of access: You have the right to obtain access to your personal data (if we are processing it), and other certain other information (similar to that provided in this Privacy Policy). This is so you are aware and can check that we are using your information in accordance with data protection law.
3. The right to rectification: You are entitled to have your personal data corrected if it is inaccurate or incomplete. 
4. The right to erasure: This is also known as ‘the right to be forgotten’ and, in simple terms, enables you to request the deletion or removal of your personal data where there’s no compelling reason for us to keep using it. This is not a general right to erasure; there are exceptions.
5. The right to restrict processing: You have rights to ‘block’ or suppress further use of your personal data . When processing is restricted, we can still store your personal data , but may not use it further. We keep lists of people who have asked for further use of their personal data to be ‘blocked’ to make sure the restriction is respected in future.
6. The right to data portability: You have rights to obtain and reuse your personal data for your own purposes across different services and platforms.
7. The right to object: You have the right to object to certain types of processing, in particular processing based on our legitimate interests. You also can object at any time to your personal data being used for direct marketing purposes (including profiling related to such direct marketing). Where you object to processing for direct marketing purposes, the personal data shall no longer be processed for such purposes.
8. The right to withdraw consent: In case you declared your consent for the processing of certain personal data by us, you have the right to withdraw the consent at any time with future effect, i.e. the withdrawal of the consent does not affect the lawfulness of processing based on the consent before its withdrawal. In case consent is withdrawn, we may only further process the personal data where there is another legal ground for the processing.
If you are not satisfied with our response to your complaint or believe our processing of your personal data does not comply with data protection law, you can make a complaint to an EU data protection authority. Users who are located in the European Economic Area (“EEA”), the European Union, the U.K., or Switzerland have the right to lodge a complaint about our data collection and processing actions with the relevant supervisory authority in their country of residence. Please note your rights in relation to your personal data are not absolute. We may, for example, deny you access to your personal data when required or authorized by law, or if granting access would have an unreasonable impact on another individual’s privacy.

Your Australian and New Zealand Privacy Rights
